When tenants move, they must leave the rented property cleanly, in the same condition as at the beginning of the lease, except in the case of appropriate fair wear and tear. With regard to housing rentals, the RTRA Act contains provisions protecting other persons who are not mentioned in a residential rental agreement (for example.B. tenants, spouses of tenants and same-sex couples in situations of domestic violence). A victim of domestic violence can ask the QCAT to end their spouse`s rental relationship and/or recognize them as a tenant because their spouse has committed domestic violence against them. The court will need some evidence of violence, but not necessarily a protection order. An application for an injunction may also be made. At the beginning of a lease, the lessor/intermediary must provide a copy of the signed lease agreement which sets out the agreed terms of the lease. The landlord/intermediary must provide a rental receipt or keep a rental report for all rents. Rental supporting documents must be presented when rent is paid in cash or by cheque. A temporary agreement – has a start and end date and can apply to any agreed term (e.g.B.
6 months or 12 months). Tenants should only sign a fixed-term contract if they intend to keep the full term, as it can be costly for tenants to “break a lease” and prematurely contract their fixed-term contract. Tenants/residents must inform the landlord/supplier of the need for routine repairs. Tenants/residents can provide notice to remedy the violation (Form 11 for housing rentals and Form R11 for housing) to give the landlord/provider some time to make repairs. When applying for a lease, applicants are not legally required to provide all the information mentioned above, but landlords or representatives cannot consider an application if the applicant refuses to provide the requested information. A periodic agreement – is an agreement during the week that lasts until the lease is terminated by one of the parties. If a fixed-term contract expires and neither party takes steps to terminate the lease, the contract is automatically transferred to a periodic “week-by-week” contract. The Department of Housing and Public Works offers bond loans and rental grants to help low-income tenants cover the costs of starting a new lease. Tenants/residents may install faucets or make changes with the written and informed agreement of the owner/supplier (ss 207, 254 RTRA Act). It should indicate whether the device is permanent and whether the tenant/resident is responsible for repairing the damage caused by the removal of a device. If a facility`s permission is inappropriately denied, tenants/residents may request mediation from the RTA and/or QCAT. Devices or modifications made without consent may constitute a violation of the agreement.
However, if the rental agreement is only oral or if the written agreement does not meet the requirements of the law, the rent laws continue to apply to all parties. In the case of a residential lease agreement, a landlord must make a declaration of sale before entering and showing potential buyers on the rented property. If a lessor sells premises on which there is a periodic rental agreement, the lessor may give the tenant a period of four weeks to leave, while there is a contract of sale on the property. The delivery date must be at least four weeks after termination. To terminate a periodic rental contract without justification, a period of two months must be specified. A temporary rental contract may be terminated for the sale of the premises only at the end of the limited period or by mutual agreement.
